These Terms of Service (“Terms”) govern your access to and use of https://arkrentals.com and any related pages, forms, and online services we operate (collectively, the “Site”). The Site is operated by Ark Rentals (“Ark Rentals,” “we,” “us,” or “our”).

By accessing or using the Site, submitting a form, requesting information, requesting availability, requesting a quote, requesting a rental, requesting service, or otherwise interacting with us through the Site, you agree to these Terms. If you do not agree to these Terms, do not use the Site.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

Submitting a contact form, rental request, quote request, service request, repair request, employment inquiry, or any other form through the Site does not create a binding contract, confirmed reservation, guaranteed availability, guaranteed pricing, or guaranteed service date.

Any response provided through the Site or through follow-up communications is preliminary unless and until Ark Rentals confirms the matter in writing and, where applicable, the customer enters into a separate written rental agreement, service agreement, invoice, work order, waiver, or other contract required by Ark Rentals.

We reserve the right to accept or decline any request, correct errors, request additional information, and determine final availability, pricing, scheduling, and serviceability in our sole discretion.

4. Separate Contracts Control

Any actual rental, delivery, setup, repair, concrete work, event service, or other transaction with Ark Rentals may be governed by a separate written contract, rental agreement, work authorization, invoice, waiver, or service agreement.

Those separate documents, not this Site Terms of Service page, will govern the specific terms of the transaction, including matters such as pricing, deposits, delivery, pickup, damage waiver, taxes, timing, cancellations, customer responsibilities, equipment use, service conditions, limitations, and other job-specific or rental-specific obligations.

If there is any conflict between these Terms and a separate written agreement entered into with Ark Rentals, the separate written agreement will control for that transaction.

5. Age Requirement

The Site is intended for use by individuals who are 18 years of age or older.

If a person under 18 wishes to submit information, request services, or otherwise interact with Ark Rentals through the Site, a parent or legal guardian must be involved and must submit or approve the request on the minor’s behalf.

By using the Site, you represent that you meet this requirement or are using the Site with the involvement and permission of a parent or legal guardian.

6. Communications

By submitting a form or contacting Ark Rentals through the Site, you consent to receive communications from us regarding your inquiry, request, project, service, rental request, application, or other matter by phone, email, and/or text message, to the extent permitted by law.

These communications may include follow-up messages, scheduling messages, request-related updates, customer service messages, and, where permitted, marketing or promotional communications.

You understand that:

• Message frequency may vary.
• Consent to receive text messages is not a condition of purchase, and

7. User Submissions

If you submit or upload any information, documents, files, photos, videos, resumes, comments, reviews, project details, event details, or other materials through the Site (“Submissions”), you represent and warrant that:

• You have the right to provide the Submissions.
• The submissions are accurate to the best of your knowledge.
• The Submissions do not violate any law or third-party right; and
• The Submissions do not contain malicious, unlawful, defamatory, or harmful material.

You grant Ark Rentals a non-exclusive, worldwide, royalty-free license to use, review, store, copy, transmit, and otherwise process your Submissions as reasonably necessary to:

• Evaluate your rental, repair, service, project, or employment inquiry.
• Provide customer support.
• Operate and improve our business.
• Document communications and work.
• Protect our legal and business interests.

8. Photos, Videos, and Documentation

Ark Rentals may take, receive, store, and use photos and videos relating to inquiries, rentals, deliveries, setups, projects, service work, repairs, completed work, and related business operations for documentation, recordkeeping, training, quality control, operational purposes, and marketing.

By using the Site and submitting a request or inquiry, you acknowledge that Ark Rentals may use such materials in a broad manner consistent with our business operations and marketing needs, subject to applicable law and our Privacy Policy.

9. Employment and Applicant Information

If you submit an employment inquiry or application through the Site, you agree that the information you provide must be truthful, current, and complete.

Submission of an application or inquiry does not guarantee employment, an interview, or any response within a specific time period. Ark Rentals may review, retain, and process applicant information in accordance with applicable law and our Privacy Policy.

Nothing on the Site constitutes an offer or guarantee of employment.

WE DO NOT WARRANT THAT:

• THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
• THE SITE WILL ALWAYS BE AVAILABLE;
• ANY REQUEST SUBMITTED THROUGH THE SITE WILL BE RECEIVED OR ACTED UPON BY A PARTICULAR TIME; OR
• ANY INFORMATION, LISTING, OR CONTENT ON THE SITE WILL ALWAYS BE COMPLETE, CURRENT, OR FREE OF ERRORS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARK RENTALS AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, AFFILIATES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARK RENTALS’ TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED $100.

NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

14. Indemnification

You agree to defend, indemnify, and hold harmless Ark Rentals and its owners, officers, employees, agents, representatives, affiliates, contractors, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• Your use of the Site.
• Your violation of these Terms.
• Your Submissions.
• Your violation of any law or third-party right.
• Any false, misleading, or unauthorized information you submit through the Site.

15. Privacy

Your use of the Site is also subject to our Privacy Policy, which describes how Ark Rentals collects, uses, and handles personal information. By using the Site, you acknowledge and agree to our Privacy Policy.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

20. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or of any other provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ark Rentals regarding your use of the Site.
